Terms of Service

1. Agreement

These Terms of Service ("Terms") form a binding agreement between you ("you", "your") and the operator of Thruwise ("we", "us", "Thruwise"). By accessing or using Thruwise — including creating an account, posting a problem, responding to other users, or sending a private message — you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the service.

2. Eligibility

You must be at least 16 years old to use Thruwise. By creating an account you represent that you have the legal capacity to enter into this agreement. If you use Thruwise on behalf of a company or other legal entity, you represent that you are authorised to bind that entity to these Terms.

3. Your account

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to:

  • provide accurate, current, and complete information;
  • use a valid email address and not impersonate anyone else;
  • not share your account or create multiple accounts to evade limits or moderation;
  • notify us promptly at hello@thruwise.com if you suspect unauthorised access.

4. The service

Thruwise is a platform that connects people with specific business problems to people with relevant lived experience. We facilitate introductions and conversations; we do not guarantee outcomes, matches, or the accuracy of any user content. Nothing on Thruwise constitutes professional, legal, financial, medical, or tax advice.

5. Your content

You retain ownership of the content you post on Thruwise (requests, Experience Notes, private messages, profile information, and any other materials you submit, collectively "User Content"). By submitting User Content you grant us a worldwide, non-exclusive, royalty-free, sub-licensable licence to host, store, reproduce, display, distribute, adapt, and otherwise use that content solely for the purpose of operating, providing, and improving the service, and for any other purpose you separately authorise.

You represent that you own or have the necessary rights in your User Content and that your content does not infringe any third-party rights or violate any law.

6. Acceptable use

You agree not to post or do the following on Thruwise:

  • spam, repetitive posts, or self-promotion disguised as a problem or experience;
  • content that is unlawful, defamatory, harassing, threatening, hateful, discriminatory, or sexually explicit;
  • content that infringes intellectual property, privacy, or publicity rights of others;
  • AI-generated content presented as personal experience without disclosure;
  • hyperlinks, contact details, or promotional URLs inside public problem posts;
  • attempts to scrape, reverse engineer, probe, or compromise the security of the service;
  • abuse of rate limits, automated submissions, bots, or scripted interactions;
  • private messages used for unsolicited sales, recruitment, or other content unrelated to the original problem.

7. Moderation

We may, at our reasonable discretion and without prior notice, remove, hide, edit, or limit visibility of any User Content that appears to violate these Terms or that we judge to be harmful to the community. Community flagging is supported: three flags from distinct users automatically hide content pending review. If you believe a moderation decision was incorrect, contact us at hello@thruwise.com.

8. Third-party services

Thruwise integrates with services operated by third parties, including Google (sign-in), Supabase (database and storage), Resend (transactional email), and Vercel (hosting and analytics). Your use of those services through Thruwise is also subject to the terms and privacy policies of those providers. We are not responsible for the practices of third-party services.

9. Intellectual property

Thruwise's name, logo, design, source code, copy, and any improvements to the service remain our property or the property of our licensors. Except for the limited right to use the service in accordance with these Terms, no licence to our intellectual property is granted to you, expressly or by implication.

10. Termination

You may stop using Thruwise at any time. You may request deletion of your account by emailing hello@thruwise.com; we will action valid requests within a reasonable time and in accordance with our Privacy Policy and applicable law.

We may suspend or terminate your access to all or part of the service if you materially breach these Terms, if your conduct creates legal exposure for us or other users, or if continued access is no longer feasible for technical or legal reasons. Provisions of these Terms which by their nature should survive termination will survive (including content licence, disclaimers, limitation of liability, indemnification, and governing law).

11. Disclaimers

To the maximum extent permitted by applicable law, Thruwise is provided on an "as is" and "as available" basis, without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, non-infringement, uninterrupted operation, accuracy, or that any advice received via the service will be correct or useful. Conversations on Thruwise are between users; we are not a party to them and we make no representations about their content.

12. Limitation of liability

To the maximum extent permitted by applicable law, we will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or in connection with your use of the service.

Our aggregate liability for all claims arising from or relating to the service is limited to EUR 100 or the amounts you have paid us in the twelve months preceding the event giving rise to the claim, whichever is greater.

Some jurisdictions do not allow the exclusion or limitation of certain damages. In those jurisdictions the limitations above apply only to the extent permitted by law, and nothing in these Terms excludes liability that cannot be excluded under applicable consumer-protection legislation.

13. Indemnification

You agree to indemnify, defend, and hold us harmless from and against any third-party claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to: (a) your User Content, (b) your use of the service in violation of these Terms, or (c) your violation of any law or third-party right.

14. Governing law and disputes

These Terms are governed by the laws of the Republic of Poland, without regard to its conflict-of-laws principles. The courts of the operator's registered place of business have exclusive jurisdiction, subject to mandatory consumer-protection rules in your country of residence which may give you the right to bring proceedings in your local courts.

Before filing a claim you agree to attempt good-faith informal resolution by emailing us at hello@thruwise.com and giving us a reasonable opportunity to respond.

15. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will provide notice — for example by email to your account address or by a prominent notice in the service — at least 14 days before they take effect. Your continued use of the service after the effective date constitutes acceptance of the updated Terms.
